OSP does not need the presence of Ken Ofori-Atta to carry out his investigation


Member of Parliament for Manhyia South, Nana Agyei Baffour Awuah is of the firm view that the Office of the Special Prosecutor does not need the presence of Ken Ofori Atta to carry out its investigation.

According to him, per the laws of the country, Ken ofori Atta can choose to appear before the OSP and not utter a word—an indication that his presence will not add anything or take anything out of the investigation.

Nana Agyei Baffour Awuah was speaking on Accra-based Channel 1 TV when he made this position known.

“Under the constitution of Ghana, you have the right not to incriminate yourself. That is why when a policeman confronts you on a matter, he reads you your caution statement that you have the right to remain silent; otherwise, anything you say will be used against you in a court of competent jurisdiction.

What it simply means is that even if I appear in your office, I can choose not to talk and so invariably, you don’t need me to proceed with your investigations because I cannot speak to incriminate myself and so the presence of Ofori Atta in the office of the special prosecutor is unnecessary”.

The office of the special prosecutor has declared Ghana’s former Minister of Finance a fugitive after he failed to appear before it over an investigation that is currently ongoing.

Reports indicate that the Lawyers of the Finance Minister have written to the OSP indicating the unavailability of their client because he is in the United States of America for medical care.

However, the OSP has vowed to use every means possible to bring him back to the country to answer questions on his involvement in several corruption-related offenses.
