Supreme court overturns re-collation of results in four constituencies


Justice Rev. Fr Joseph Adu Owusu Agyemang has squashed the re-collation of results in 4 constituencies; Tema Central, Ablekuma North, Techiman South and Okaikwei Central.

Recall that the NDC and its parliamentary candidates petitioned the Supreme Court for certiorari in an attempt to reverse the ruling of the High Court.

They claimed that because their candidates were not given a hearing before the issuance of the mandamus orders, the decision went against natural justice.

Additionally, the NDC argued that the High Court erred in failing to order the NPP candidates to notify them of the mandamus applications, as required by Order 55 regulation 5(2) of C.I. 47.

After hearing the cases of both political parties, Justice Rev. Fr Joseph Adu Owusu Agyemang presided over the case and annulled the results of the parliamentary elections for Okaikwei Central, Tema Central, Ablekuma North, and Techiman South due to electoral process challenges.

However, the results for the Nsawam Adoagyiri and Ahafo Ano North were withheld.

“We have taken note of the fact that the applicant is not content that they had earlier completed collations in respect to Nsawam Adoagyiri and Ahafo Ano North constituencies. Since the orders which have been brought to be squashed are separate and distinct we have decided to exercise our discretionary power.

“.……….We hereby squash the mandamus made by the Electoral Commission for the collation of results in the following constituencies;
Okaikwei Central
Ablekuma North
Tema Central
Techiman South

Accordingly, the results of the above constituencies by the Electoral Commission after 20th December 2024, on the order of the court are hereby annulled” Justice Rev. Fr Joseph Adu Owusu Agyemang said.
