A suit filed against the victories of President Muhammadu Buhari in 2019 and Bola Tinubu in 2023 has been struck out by the Supreme Court.
Delivering the judgement on Monday, a five-member panel of judges led by Justice Uwani Abba-Aji “frivolous and vexatious suit by Ambrose Albert Owuru which challenged the results of both presidential elections.
The court also awarded a N5 million damages against the appellant and in favour of former president Buhari and President Tinubu, the Independent National Electoral Commission and the Attorney General of the Federation – all defendants in the matter.
According to the details made available by the Assistant chief state counsel, Owuru case had earlier being dismissed by the Supreme Court in 2023.
The counsel, Adedayo Ogundele said, “He sent a younger counsel, and the apex court dismissed it.”
Giving the court’s ruling, the judge stated that Owuru’s application is “incompetent and is hereby dismissed.”
The court also stated that the habit of serially filing suits by Owuru is unbecoming of a Senior Counsel of his years of experience (called to the bar in 1984).
It state that his action are an abuse of process of the court and that he must be penalised for wasting the time of the court.
The Supreme Court further slammed a N5 million fine on the appellant, in favour of the defendants.
